The Federal Acquisition Regulation Council has published an interim rule that has implemented the No Tik Tok On Government Devices Act. This act was included in the Consolidations Appropriations Act, 2023 (Pub. L No. 117-328) made into law December 2022. The interim rule prohibits the use of Tik Tok or other applications by ByteDance on a contractor’s information technology. This includes employee-owned devices that are used a part of Bring Your Own Device program (BYOD).
The rule adds a clause to FAR 52.204-27, Prohibition On A ByteDance Covered Application prohibiting the use of Tik Tok on information technology owned or managed by the government, or any information technology used or provided by the contractor under the contract. This includes equipment provided by the contractor’s employees.
Contracting Officers will include the new clause as of June 2, 2023 in solicitations, contract awards, etc.
